Warranty and Limitation of Liability:

Mystodiac Inc. shall not be liable for delayed, undelivered, or failed text messages.

Nothing in this provision prevents either party from seeking temporary or preliminary equitable relief from a court of competent jurisdiction.

Class Action Waiver:

To the fullest extent permitted by law, any proceedings, whether in arbitration or court, will be conducted only on an individual basis and not as a class, consolidated, or representative action. If a claim proceeds in court rather than arbitration, both parties waive the right to a trial by jury in any action related to this agreement or any transaction contemplated by it.

Arbitration Award:

The arbitrator may award any remedies permitted by applicable Michigan law but may not modify these Terms.

The arbitrator's decision shall be final and binding and may be enforced by any court having jurisdiction.

Arbitration Costs:

Each party shall bear its own legal costs unless otherwise awarded by the arbitrator under applicable law. Arbitration fees shall be shared equally unless otherwise required by law.

Confidentiality:

The arbitration proceedings, evidence, and award shall remain confidential except as necessary to enforce or challenge the award or as otherwise required by law.

Miscellaneous:

By participating in the Mystodiac Inc. Mobile Alerts Program, you represent that you have the legal authority to agree to these Terms.

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

Mystodiac Inc. reserves the right to modify these Terms at any time. Updated Terms will be posted on our website, and your continued participation after any changes become effective constitutes your acceptance of the revised Terms.
